Is Lake View One Of Your Riparian Rights?

By Maria Keeney In short, yes. Lake view is one of your riparian rights. If you own lakeshore property, you are afforded the following riparian rights (also called littoral rights) according to the Public Trust Doctrine. 1. Access (right of swimming, boating, fishing, etc.)
2. Navigability (right of access to a point of navigability)
3. Right to erect structures (right to erect docks and boat lifts, etc.)
4. Water use (right to use water for domestic purpose)
5. Accretions (right to land obtained by water level fluctuation)
6. View (right to view and right to preservation of view) There are many ways your right to lake view might be infringed upon. Here are a few scenarios: Pretend you just bought a beautiful lake home with a gorgeous view of the lake. You continue to enjoy this view undisturbed for the next few years. Until one day a neighbor builds a large three story home closer to the shoreline which results in your lake view being severely diminished. You may have purchased a lake home in the winter time. When spring arrives, your adjacent neighbor places their dock and boat lift so that it extends in front of your home and not theirs, obstructing your view as well as your access. Maybe an adjacent neighbor remodels their boat house by the lake making it a double story boat house, which in turn obstructs your view of the lake. Or a tall fence is erected along the property line, which results in your inability to enjoy the same view of the lake you once did. You could also quite possibly have a case for the riparian loss of right to view when you dont even own lakeshore. There was a case that involved ocean views in Florida whereby a condo owner that did not even own lakeshore sued a developer who built a structure directly in front of the condo owners view of the ocean. The condo owner lost his entire view of the ocean but recovered damages in a court of law. The above scenarios may or may not be serious infringements. It most often depends on the characteristics of your lot. Many people just dismiss the loss of a lake view as the cost of development, but others see it as an infringement on their riparian rights.
If your lake view has been diminished in some way, you will be glad to know that there are remedies. First, check with your local city or county to determine if there are any ordinances that are being violated. If so, the activity causing the infringement on your riparian right may be stopped. Second, you may be able to communicate with the neighbor who is infringing on your views and ask them to modify their plans. Keep in mind that attempts to resolve these types of disputes with neighbors rarely works because the neighbor has probably already contemplated your loss of lake view during the planning phase and determined they would go ahead anyway. So make sure you keep your communication as non-confrontational as possible to avoid damaging your friendship as well. It is a cheap alternative and one that might work. You are also letting your neighbor know that you oppose his/her actions. The last remedy you can try is to take them to court. Be aware that the law is not clear on decisions regarding the riparian right to view. This is intentional because every situation must be handled uniquely. The nature of shorelines, water level fluctuations, amount of land relative to adjacent owners, what is “reasonable use”, etc could all have impacts on whether the court decides in your favor. Of course, if you have an obvious inequity you stand a better chance in a court of law, but as in all court cases you cannot predict the outcome with any certainty. That said, if you feel that your riparian rights have been infringed upon and have tried other alternatives for remedy to no avail, you can always ask a court of law to decide whether or not monetary or injunctive relief should be granted in your favor. Avoid These 10 Design Disasters When Creating Your Business’ Marketing Materials

By Katrina Sawa Have you ever noticed how many articles there are on creating your own marketing materials? These articles concentrate on things you “should do,” offering such clever advice as “Know your audience,” “Say it with pictures” or “Write clearly and distinctly.” Now I’m not saying any of that is bad advice. But you should also know what not to do. That’s what this article is about. Or more specifically, it’s about what most do-it-yourselfers are tempted to do–but shouldn’t. Nothing screams “Design Novice” like the following 10 mistakes: 1. Don’t enlarge your logo so it’s the main focus of the page. Yes, your logo features the name of your company. But it’s not the main point. People are interested in what you’re selling, not who you are. In fact, the smaller your logo, the more established your company will appear. Besides, if they are interested in what youre selling or promoting, they will look to the bottom to find out where to get it. 2. Don’t place your logo in the text of your piece. Of course it’s fine to use the name of your company in the text of any of your marketing materials, but inserting your actual logo into a headline or body copy is design suicide. 3. Don’t use every font at your disposal. Choose one or two fonts for all your materials to build your brand. Your font choices should be consistent with your image and your industry. Cursive and creative fonts are often hard to read, know your audiences ability to read such things and they must still stand out. 4. Don’t use color indiscriminately. More color doesn’t necessarily make something more appealing. Often it just makes it loud and annoying. When someone screams at you, do you want to listen or run away? Most, if not all, your text should be the same color, preferably black for readability or red for a call to action. For a unique look, try duotone photographs or print in two colors. If you plan to use full color on a piece make sure you really utilize that color instead of just putting it in your logo for example and nowhere else thats just a waste of color and youre paying extra for that. On the flip side, try not to use too many colors in the text; Ive seen sometimes 5-7 colors in the text on just a business card and that makes nothing stand out plus its hard to follow. 5. Don’t be redundant. Don’t repeat the name of your industry or product in your company name and your tagline and your headline. Potential customers know your industry. Restating it implies you don’t. 6. Don’t choose low-quality or low-resolution photography. A photo may look great in an album, but unless it features balanced lighting and good composition, it’s not print-worthy. Photos need to be at least 300 dpi. And yes, people can tell the difference. 7. Don’t fill up every inch of white space on the page. White space, or negative space, brings focus to what’s important and gives the eye a rest. You may have a lot to say, but cramming it all in creates chaos and minimizes impact. Your piece will end up visually overwhelming. Think less, not more. Besides you should have a website now that people can go to for more detailed information. 8. Don’t focus on the details of your product or service; instead, focus on how it benefits your audience. Unless your product is extremely technical, make your offering relevant to your audience by emphasizing its benefits, not its features. Otherwise it’s like going to a party and talking about yourself all night. That’s not exactly the best way to win friends or gain customers. Your heading and your message must hit your target markets hot buttons and whats in it for them? 9. Don’t do exactly what your competitors are doing. When you’re positioning your product, it’s good to know your competition. But don’t copy them. Find out what your customers want and are attracted to. Stand out without sticking out. If you can take your logo and place it in your competitors ad and it applies and vice versa then youre not getting creative or unique enough with your message and you just look like everyone else. Besides, who knows if theyre getting good response on their ads? They might not be. 10. Don’t change design styles with every marketing piece you create. Strive for a consistent look and feel, keeping the same fonts and logo placement. If you use photos in one ad, don’t use illustrations in another. If you place your logo in the middle of one brochure, don’t place in at the top-right corner in another. You get the gist. Finally, do be clear, clean, compelling and consistent. are the dwarf-sized trees that have been developed in the Asian
countries of China and Japan for many hundreds of years. Most
people have to go out to a forest to experience the marvelous
plants that we call trees. But in the hands of a master Bonsai creator, the beautiful trees
can be reduced in size to the point where they can be brought
indoors to be enjoyed at any time. And the person who learns
this age-old art so that he or she learns how to create this
small piece of beauty experiences even more of a thrill –
something closely akin to producing a child, but with the added
advantage of being able to shape and design it themselves. And
these trees grow more beautiful with age. Some renowned trees
are as old as five hundred years or more. Naturally, they need nurturing and care, just as any prized
possession does, especially things that are living and
developing, in the same way a child develops. But the care that
is needed is not difficult, though it may require some time and
some special equipment (not overly-expensive). And, of course,
these beautiful trees can be purchased at any Bonsai nursery. Usually it never enters the head of the admirer of Bonsai that
they have the potential of creating them on their own. Becoming
a member of any local Bonsai Club (they’re virtually everywhere)
will provide all the support and direction a person might
require. It’s exciting to sit in front of one of these miniature
trees and realize that this tiny tree in its tiny pot might
otherwise be growing tall in some forest somewhere. And you can
pick it up, turn it, and see all sides of it without leaving your
chair. They truly are a marvel, these Bonsai trees. The word Bonsai
itself means “tree in a pot.” And there is not just a single
species of tree that is adaptable to your particular area. There
are hundreds — even species that would normally not be
considered a tree, such as shrubs, bushes and even plants like
roses and many herb species. But, no matter what kind of plant
you may have in your pot, it’s always called a “tree” in Bonsai
language. I was fortunate enough to have been able to study with the great
master, John Naka, also addressed as “Sensei” (master teacher).
Sadly, Sensei Naka left us a few years ago, and has been greatly
missed by all who knew him and knew of him. He wrote the
consummate manual on the subject of Bonsai, which was his true
passion. He traveled all over the world to teach and judge
competitions and he loved every minute of it. He made his home
in Southern California, but the world was truly his, gaining
enormous respect wherever he traveled. If you’re thinking of creating or buying a Bonsai tree, you must
bear one thing in mind at all times — these are living things,
and do require care and even love. You can’t go away on vacation
for a week or two and expect to find your tree alive when you
return — unless you’ve wisely made arrangements to have someone
take care of your tree for you. And that person must know
intimately the requirements of the tree. A trusted neighbor who,
upon seeing the tree for the first time, says, “Oh, isn’t that
cute?” is not the person to entrust your tree with. The principle tree for a beginner to start with is the Japanese
Black Pine (pinus thunbergii), primarily because its the easiest
to grow and work with, and also that it’s available in most areas
and climates. It can be grown anywhere in the U.S. and most of
North America. It’s extremely hardy and adaptable to even
adverse weather conditions and makes a superb-looking Bonsai

I got hold of the ebook some time ago, and have read it a number of times. During my fat loss phase I probably referred to the book once a week. Apparently it’s been one of the top-selling weight loss ebooks for over a year now, so I thought I’d give my spin on it. So what’s so good about it? There are loads of weight loss ebooks out there. After a brief search, I found no less than 88 diet ebooks! Over the past few years I have had the opportunity to read a few of these. The reality is - most of these ebooks are crap. Forgive the crudeness but it’s true. Many of them are cheaply produced generic diet plans that you might try for a few weeks, and then throw out. After delving into BFFM I discovered this was quite unlike any other diet book. There are no promises of outstanding breakthroughs or secret methods - just simple facts about fat loss. However the book is anything but simple - there’s a lot of science and a lot of reality. There’s no pictures at all, only words plus a few tables so it’s not something you can read in an hour. Plus there are some points where you may need to read a few times and take notes as well. I highly recommend you print it out and use it as a reference. Lent was not Ordained by GOD

By Cornelius Babasanya-Craig Christians accept the Lenten season as if it is part of GODs plan for their salvation. The truth is that Lent is completely fallacious, and should be treated as such. Now, it is no more than a calendar event; only a few observe what it demands. The forty days of Lent represent the forty days which Jesus spent in the wilderness at the outset of His Ministry. He did not just stumble unto the fast. The Bible tells us: Then Jesus was led by the Spirit into the desert to be tempted by the devil. After fasting for forty days and forty nights, he was hungry. The tempter came to him and said, If you are the Son of GOD, tell these stones to become bread. Matthew 4:1-3. The fast was His preparation to face temptation by Satan. This world in which we live is in the domain of Satan. Evildoer The main point we are making here is that man cannot save himself. Salvation is entirely at GODs mercy. He designed it. Also, it is at His prerogative that we are saved. It is not in dispute that it is a good thing to fast, or to be contrite for your sins. The point is that it contributes nothing towards your salvation. You may reinforce your prayers with fasts. That your prayers are answered contributes nothing towards the salvation of your soul. You may even pray and raise the dead. It is still the same thing. Simply, you have asked, and you have received. After all, respecting the Judgment Day, Jesus says: Not everyone who says to me Lord, Lord, will enter the kingdom of heaven, but only he who does the will of my Father who is in heaven. Many will say to me on that day, Lord, Lord, did we not prophesy in your name, and in your name drive out demons and perform many miracles? Then I will tell them plainly, I never knew you. Away from me you evildoers. Matthew 7:21-23. You are not an evildoer when the Spirit directs your spirit to do the will of GOD. You are then a son of GOD, Romans 8:14 and you have the righteousness of GOD. On the other hand, your self-righteousness is like a filthy rag before Him. Isaiah 64:6. The Bible says: For it is by grace you have been saved, through faith—and this is not from yourselves, it is the gift of GOD—not of works, so that no one can boast. Ephesians 2:8-9. If salvation were of works, especially as demanded by Lent, then you would be entitled to expect salvation if you have fulfilled your part. You may even want to demand it as of right. Salvation is for the soul Jesus Christ says that His words are spirit. Paul, on his part, says that the law is spirit; therefore flesh and blood cannot obey it. This explains why activities in flesh and blood contribute nothing towards salvation. It is unfortunate that the intrinsic concept of salvation has eluded the majority of Christians. Salvation is a spiritual matter. It is the soul or spirit that needs it and can achieve it. You are saved when your spirit becomes suitable for a life with GOD. In the Garden of Eden, man died in the spiritual and continued existence in the physical nature of flesh and blood. It is the resurrection of Jesus Christ in the Spiritual that guarantees mans return to spiritual life with GOD where eternal life is possible. This is why Jesus Christ was able to be categorical: I am the way and the truth and the life. No one comes to the Father except through me. John 14:6. Of course, GOD is Spirit. The only way for man to come to the Father is to unite with Jesus Christ in His death and resurrection. This is achieved through baptism when properly done. Otherwise, it is meaningless and achieves nothing. Maybe you can now see what happens when you are born of water as Jesus demands. What Lent is all about The purpose of Lent is to enlist empathy for the sufferings Jesus Christ went through during His last days on earth, ending in His Crucifixion. What for? This is analogous to the case of a patient who had to undergo surgery to get well. He now sets aside some days during graduation as an annual event, observing sleepless nights in empathy with the surgeon who, as a student, had to swot for many nights. The irony is that, while doing all that, he has not been faithful to his medication. His health is still constantly threatened. Really, the Lenten season has given the purpose of Easter a somersault. Christmas marks the birth of Jesus Christ. Angels, even, rejoiced at it. Easter marks the triumphant completion of the Mission of Jesus Christ. By all means, this should be approached not with fasting, and soberness, but resounding jubilation. Our salvation becomes a certainty. The end of a thing is more important than its beginning. Ecclesiastes 7:8. Christians make it appear as if the LORD GOD did not approve the sufferings. Isaiah prophesied: Surely he took up our infirmities and carried our sorrows, yet we considered him stricken by GOD, smitten by him, and afflicted. But he was pierced for our transgressions, he was crushed for our iniquities; the punishment that brought us peace was upon him, and by his wounds we are healed. Isaiah 53:4-5. There you are. The LORD GOD condemned Lent about 700 B.C. The feeling of sorrow during Lent is misdirected. Rather, we should jubilate that the LORD GOD has worked out our salvation, and be thankful. Jesus says: As the Father has loved me, so have I loved you. Now remain in my love. If you obey my commands you will remain in my love, just as I have obeyed my Fathers command and remain in his love. John 15: 9-10. Jesus Christ shed his blood to establish the New Covenant. A good deal of Christians have no idea what the promises of GOD in this Covenant are. They are not committed in any way to ensure these promises are fulfilled for them. Unfortunately, salvation is impossible outside this Covenant. Indeed, Jesus Christ wants to save you, wants to love you. The ball is in your court. Popup Santa — Kids Christmas Make

By S. Roberts Watch as Santa Claus pops out of the chimney pot. But don’t get him stuck because if he catches you he won’t bring you any Christmas presents. To make a popup Santa you will need - 2 loo-roll tubes. One needs to be slightly bigger than the other, so that one can easily slide up and down inside the other tube. The larger tube is the chimney pot. Cover this tube in paper or paint to look like a chimney pot. The smaller tube is Father Christmas. Stick on paper or paint this tube to look like Santa Claus. Give him a long white beard and a bright red coat. Stick on a strip of red paper around the top of the tube so that the paper over hangs the tube. Scrunch the top edge of the paper to form Santa’s hat. Stick a cotton wool ball on the top to finish it off. The glue helps to keep the scrunched up edge nicely in place. Cut out two thin strips of card. Stick them on the side of Santa to make his arms. The turn over you make to stick on the arms acts as a hinge later. Santas arms will pop out of the chimney as Santa appears. When Santa is complete and the glue or paint is dry, cover Santa in sticky clear book protector or clear selotape. This reduces friction as Santa slips up and down inside the chimney. Put Santa inside the chimney. Put your fingers up inside the chimney to mover Santa up and down so that he appears to POP out of the chimney.
